2022

The concept of an emergency situation can be considered a novelty in the international legal system that gained its overwhelming importance due to the spread of Covid-19 pandemics all over the globe. Was the international community ready to employ clear and well-structured mechanisms of emergency situation concept in the context of human rights protection? Was the Latvian legal response to the Covid-19 emergency in the field of human rights protection successful? The “institution of emergency” in the international area was developed by the ECHR, whose ideas were incorporated into Latvian constitutional system and legal order. Krajowa Rada Narodowa i Polski Komitet Wyzwolenia Narodowego w państwie prawa. Stanowiska doktryny

2021

<p>The establishment of the communist regime in Poland in 1944 is a current subject of reflection in the doctrine and practice of legislation and judiciary. There has been no uniform position on these events, which means that the then sanctioned political and normative order continues to produce controversial assessments and, above all, certain legal effects. This results from the fact that the new people’s power, empowered by force, and not by legal or social basis, has given itself the competence to establish a normative order. The lack of legitimacy for the rightful rule and legislative activity, in principle – from the point of view of the idea of the rule of law – undermines the …

Usually, informal constitutional change is determined by various factors, among which the lack of clarity or the extreme rigidity of the Constitution. Somali Contract Law: Constitutional and Comparative Perspectives

2019

The Somali legal system had a very peculiar development. After colonisation, the independent country adopted a Civil law based legal system largely influenced by Italian law. The Civil Code adopted in 1973 was modeled on the Egyptian homologue enriched with other influences, mainly Italian. From the constitutional perspective, the country had three constitutions before the collapse of the state, followed recently by a provisional constitution that introduces a federal system to try to keep the unity of the State under the federal umbrella. The 1973 Somali Civil Code is formally still in force, as after the fall of Siad Barre the state failure brought with it the lack of any authority capabl…
